Down the aisle with a smile

Amanda and Cody had a sweet ceremony at the Mcmenamin’s Edgefield Hotel Garden on July 23rd. I was honored to be their wedding photographer- for such a straightforward and personal ceremony, this also happened to be one of the most fun receptions I’ve been a part of! Photographers – Consider Using Conditions in Your Licenses 2011-09-14

The Licensing Law Blog reported on a recent case where the court held that the language of the contract prevented the copyright owner from recovering damages for the unauthorized use of its copyrighted work (software, in this case).  The court found that because the language in the software owner’s license agreement was in the form of a covenant or promise (the “User agrees that it will . . .”) rather than a condition or a premise upon which the fulfillment of an agreement depends (the “User may use software provided that it . . .”), the court held that the software owner could not recover any copyright infringement damages for the alleged unauthorized use.

What does this mean for photographers? …when preparing an agreement to license a photograph, include language such as “No rights are granted to Client until Photographer has received payment in full.” That, and registering your photos with the Copyright Office, are great ways to protect your work.

Three Generations on Pelican Butte 2011-09-08

While taking a look atop Pelican Butte- which is near Klamath Falls, OR- I took a few photos of the Klingerman family. It was a short expedition, but the vista was pretty compelling nonetheless! Of course, there was no shortage of hamming it up for the camera from young Asher… That little guy was made for the camera, and he’ll jump at any opportunity to prove it! Good times. Oregon is beautiful.
